Dubai introduces regulations to address neighborly privacy violations and nuisances
In the UAE, property owners are obliged to avoid causing inconvenience to their neighbors or their properties, as stipulated in Article 1144 of the UAE Civil Transactions Law.
This provision emphasizes the importance of exercising property rights responsibly and not to the detriment of neighboring properties. Noise disturbances, which are defined in Article 74(1)(e) of the Dubai Municipality Local Order No. 61 of 1991, are particularly relevant. This legislation defines noise as any disturbance that unreasonably interferes with the peace, comfort, and convenience of others, excluding those within the premises where the noise originates.
If people are inconvenienced by noise coming from surrounding businesses, they can lodge a complaint with the Dubai Municipality's Noise Control Officer. If the Noise Control Officer determines that further action is required, including the involvement of the police, they are authorized to investigate the complaints and take appropriate action. On top of that, the Dubai Municipality has the authority to issue orders about excessive noise disruptions; violators may face fines or even have their noise-making devices confiscated.
Additionally, it is essential to understand the legal framework concerning indecent behavior, particularly concerning the decency of women in public spaces. Article 412(1) of the UAE Penal Law imposes penalties, including imprisonment and fines, for actions or words that offend the decency of a woman in public. Moreover, indecent behavior against women under the age of eighteen is considered a serious offense, subject to harsher penalties.
In light of these legal provisions, individuals facing noise disturbances from neighbors or experiencing indecent behavior should consider filing complaints with the relevant authorities, such as the Dubai Municipality and the Dubai Police. These authorities have the mandate to intervene and address such issues to ensure a peaceful and respectful living environment for all residents.
