UAE Part-Time Employment: Hours, Leave, Multiple Jobs Explained
Federal Decree-Law No. 33 of 2021 and associated resolutions provide the legal framework that must be understood in order to navigate the complexities of part-time employment in the UAE.
Understanding Part-Time Employment Regulations in the UAE
An important part of the job market in the UAE is part-time work permits. Cabinet Resolution No. 1 of 2022 and Article 7(1)(b) of the Employment Law both provide that workers can be granted part-time permits, which enable them to work reduced hours for numerous companies.
Administrative Guidelines
Administrative Resolution No. 38 of 2022 lays down guidelines for obtaining part-time work permits from the Ministry of Human Resources and Emiratisation (MoHRE). These permits are typically issued for a year and require specific documentation, including passport copies, attested academic certificates, and a signed employment contract.
Permit Requirements
MoHRE imposes certain criteria for part-time work permits, such as a minimum age of 18, alignment of the employee's designation with the employer's activity, possession of a valid UAE residency visa, and a violation-free employer's licence.
Annual Leave Calculations
Depending on the total number of hours worked in a year, part-time workers are eligible for paid vacation. This computation is detailed in Article 29(2) of the Employment Law and takes into account the number of working days in a year, the ratio of part-time to full-time work, and the actual working hours.
Gratuity Calculation for Part-Time Employees
The annual total of a part-time worker's hours worked is the basis for their gratuity. Article 30 of Cabinet Resolution No. 1 of 2022 and Article 52 of the Employment Law detail the calculating process, guaranteeing equitable remuneration based on the percentage of full-time benefits.
The legal structure in the UAE that governs part-time employment is rather clear, which allows workers a lot of leeway while still protecting their rights. It is critical for both employers and employees involved in part-time employment agreements to have a good grasp of these rules.
